Maternity leave - Article 12 of the "Shanghai Regulations on Labor Protection for Female Employees" stipulates that if a woman is pregnant for more than 7 months and is approved by her work, she can apply for maternity leave on her own and the company approves it. The maternity leave is about 2.5 months.

During the maternity leave, employees should be treated as if they were present at work. If they do not take maternity leave, they will have a one-hour break every day, will not be assigned to night shifts, and will be paid the usual wages. It should be emphasized that there are three criteria for taking maternity leave, namely approval from work, self-application, and company approval.

Maternity leave refers to the holiday pay benefits that employed women receive before and after the delivery of their children. It usually starts from a dozen days before delivery to about two and a half months after the birth of the child. For those who marry and have children late, it can be up to four months after the birth. Pregnant women are entitled to no less than ninety days of maternity leave. While a working woman is on maternity leave, her employer may not reduce her salary, fire her or terminate her employment contract in any other manner. Working women are entitled to maternity insurance salary benefits during maternity leave, and the social security fund will reimburse relevant medical expenses and pay maternity insurance. If a working woman does not sign up for maternity insurance, the employer will bear the cost.

The maternity leave standards currently implemented in our country are based on the "Special Provisions on Labor Protection for Female Employees (Draft)" decided and standardized by the Executive Meeting of the General Office of the State Council on April 18, 2012. The proposal increases the maternity leave for pregnant female workers from 90 days to 98 days, and standardizes related salary benefits.
